TERMS AND CONDITIONS OF SALE
The sale and supply of all products via the Skins web site (“Products”) is governed by the following terms and conditions (“Terms and Conditions”). These Terms and Conditions should be read in conjunction with the web site’s Privacy Policy and Terms and Conditions of Use:

1 SKINS LIMITED
1.1 The Skins web site is provided by Skins Limited (company number 05876524), whose registered office is Unit 5, Three Spires House, Station Road, Lichfield, Staffs, WS13 6HX, England. Skins Limited’s VAT registration number is GB925178413
2 TERMS OF USE
2.1 If you accept these Terms and Conditions, please click on the button marked "I accept" at the end of this page before ordering any Products. If you do not accept these Terms and Conditions you will not be able to order any Products.
3 CHANGES TO THESE TERMS AND CONDITIONS
3.1 We may from time to time make changes to these Terms and Conditions. Any changes will be posted on our web site and notified to you by means of a notice and links to the revised Terms and Conditions on our homepage. Please review these Terms and Conditions regularly to ensure you are aware of any changes made by us. If you place orders for Products after notice of changes are posted in this way this will indicate that you agree to be legally bound by the Terms and Conditions as updated and/or amended. In the event you do not agree to any revised Terms and Conditions, you should not place further orders for Products.
4 AGE REQUIREMENT AND ACCURACY OF INFORMATION
4.1 Registration and use of the web site is only available to persons age 18 years and over. You promise to us that the details you give to us whilst using the web site are correct, in particular, the credit/debit card you are using is your own.
4.2 If your details change, it is your responsibility to inform us via the web site or by contacting us as set out in the Contact Us section at the end of these Terms and Conditions.
5 HOW THE CONTRACT IS FORMED
5.1 All orders are subject to acceptance by us. After you place an order, we will acknowledge receipt of your order by sending you an order acknowledgement email. This acknowledgement email will not constitute our acceptance of your order. Your order will only be accepted by us when we send you a shipping confirmation email when we have dispatched your order.
5.2 Skins will use its reasonable endeavours to keep copies of all contracts for orders placed for Products by you, but cannot guarantee that it will keep a copy of every agreement for an unlimited time due to the number of orders for Products that it receives. You should therefore print out a copy of these Terms and Conditions and the shipping confirmation email in relation to all purchases and keep them in a safe place as a record of each transaction.
5.3 Contracts with Skins are concluded in English.
6 PRICES AND PAYMENT
6.1 The prices for any Products ordered will be as quoted on our web site from time to time, except in the case of obvious errors. All prices are inclusive of VAT and the cost of delivery (see "Delivery").
6.2 You may pay for your order by credit or debit card. Credit card and debit payments can be made either on-line (via our SSL secure payment system), or by phone using one of the following credit cards: VISA, Mastercard or Switch. We will charge your credit card or debit your bank account or cash your cheque when we acknowledge your order. All credit card payments are subject to validation checks and authorisation by the card issuer.
7 DELIVERY AND AVAILABILITY
7.1 We anticipate all Products ordered via our web site will be delivered to the address specified by you within our standard delivery time of 5-7 working days from the date when payment for the Products is received by us in cleared funds. If you wish to arrange a different delivery period, you can Contact Us and we will try to accommodate your request, but we cannot guarantee that we will be able to meet your required timescale.
7.2 All Products are subject to availability. Where any Product turns out to be temporarily unavailable, we may offer a replacement Product to you. You have the right to accept or refuse this replacement Product. If you choose to refuse it you will be able, at your option, to either order another Product from our web site or cancel your order and claim a refund.
7.3 If the Products have not been delivered within 5-7 working days from the date when payment for the Products is received by us in cleared funds please Contact Us in writing, and we will attempt to trace the Product send out a replacement Product or suitable alternative.
8 CHANGES TO SPECIFICATIONS
8.1 We may at any time make any changes to the design and/or manufacture of the Products that are, in our opinion, an improvement to such design and/or manufacture. We may supply suitable substitutes for any materials comprised in the Products that become unobtainable, for example due to a change in applicable law or regulation or the unavailability of materials from suppliers.
9 OWNERSHIP AND RISK
9.1 We retain ownership of all Products ordered until they have been delivered to you. Ownership of and risk in all Products shall pass to you upon delivery.
10 OUR REFUND POLICY
10.1 You may cancel your order at any time and for any reason within 7 working days of delivery of the Products ordered. (‘working’ days do not include Saturdays, Sundays and public holidays). Orders for certain Products may not be cancelled - these include: (a) Products that have been clearly personalised; (b) Products that are perishable; and (c) Products if they have been worn or used in any way. If you wish to cancel your order you must notify us of your wish to cancel in writing and you must return the Product(s) to us (at your expense) in their original wrapping, intact and accompanied by all accessories and documentation which were part of the delivery. We will refund any monies paid to us in respect of a cancelled order within 30 days of receiving your notice of cancellation.
11 NOTICES
11.1 Where these Terms and Conditions require you to notify us of certain things in writing, notices should be sent to us by post to our address below (see the Contact Us section below) or by e-mail at sales.europe@skins.net. If we need to notify you of anything, we will do so by e-mail or post to the e-mail or postal address you provide during the order process. Notices will be deemed received 24 hours after the e-mail is sent or three days after the date of posting.
12 CANCELLATION OR DAMAGE
12.1 If you receive a Product which is faulty or damaged please notify us immediately by one of the methods specified in the Contact Us section below and return the relevant Product to us together with a brief explanation of the fault or damage. Upon receipt of the Product, we will examine it and conduct a test to see if it is faulty or damaged. We may, as we think appropriate, credit you with an appropriate sum in respect of the Product. In any event, we shall (subject to availability) send you a replacement Product or suitable alternative.
12.2 We shall have no obligation to repair or replace Products:
12.2.1 that have been altered or repaired by persons other than us;
12.2.2 that have been improperly stored and/or handled; or
12.2.3 that have become defective due to negligence or accident (other than by us).
12.3 This does not affect your statutory rights.
13 GENERAL
13.1 Subject to Clause 14.2, our maximum liability under or in connection with any Products shall not exceed the price paid by you for such Products.
13.2 Nothing in these Terms and Conditions shall exclude or in any way limit our liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent that the same may not be excluded or limited as a matter of law.
13.3 We shall not be liable for any failure to provide the web site and/or the failures or delays in delivery where this is due to circumstances beyond our reasonable control.
13.4 These Terms and Conditions set out the full extent of our obligations and liabilities in respect of the supply of the Products and there are no conditions, warranties, representations or other terms, express or implied, that are binding on us except as specifically stated in these Terms and Conditions.
13.5 If any provision of these Terms and Conditions is found to be unenforceable, it shall so far as it is unenforceable, be deemed deleted and the remaining provisions of these Terms and Conditions shall continue to apply.
13.6 The English Courts will have exclusive jurisdiction over any claim arising from or related to this web site and all Products. English Law will apply to these terms and conditions.
